If you received a notice from the New York Compensation Insurance Rating Board, the state has flagged your company for a mandatory workplace safety and loss prevention consultation. Employers qualify when annual payroll is over $800,000 and the experience mod is over 1.20. This is not optional, and it runs on fixed deadlines.
CompShield performs the consultation with a consultant certified by the New York State Department of Labor. One flat fee, no hourly billing, and the work does not stop at compliance. The same team that writes your evaluation can run the fixes and manage the claims driving your mod.
The deadlines
- Within 30 days of the notice: arrange the consultation and evaluation
- Within 10 days after arranging it: notify your insurer and the Department of Labor in writing, with the consultant's name, address, and certification number, plus the evaluation dates
- Within 75 days of the notice: the consultation must be finished and the written evaluation delivered
- Within 30 days of receiving the evaluation: send a copy to your insurer and the Department of Labor, with a written statement of how and when you will complete the recommended remedial action
- Within 6 months: complete the remedial action. Your carrier then re-inspects and reports back to the Department of Labor
What the flat fee covers
Priced at $2,500 for employers holding a Code Rule 59 notice. That is $1,000 off the standard $3,500 CompShield Audit fee. The fee covers the consultation, the written evaluation the state requires, and the notifications support so your insurer and the Department of Labor get the right information on time. If you engage CompShield for ongoing claims management afterward, the full $2,500 is credited toward it.
Why CompShield instead of a safety-only firm
A safety firm can get you compliant. It cannot do much about the claims that put your mod over 1.20 in the first place. CompShield covers the full life of the problem: safety and prevention before the accident, investigation when one happens, carrier oversight and reserves after filing, and loss run and mod review to bring the number back down. Compliance gets the state off your back. The claims work is what lowers your premium at renewal.
